AND SESSIONS JUDGE AT BENGALURU AND PERMIT THE PETITIONER TO COMPLY THE ORDER DATED 25.02.2025 IN CRL.A NO.283/25 PASSED BY THE 64TH ADDL.CITY CIVIL AND SESSIONS JUDGE, BENGALURU AND PROCEED WITH THE CASE ON MERITS.
THIS PETITION, COMING ON FOR ADMISSION, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE SACHIN SHANKAR MAGADUM
ORAL ORDER
This matter was adjourned to enable the petitioner to demonstrate her bonafides. Learned Senior Counsel, on behalf of the petitioner, has fairly sought a brief accommodation to secure a demand draft for 20% of the fine amount, as directed by the appellate Court while granting conditional stay of the conviction.
2. It is noted that the petitioner has now secured the demand draft, thereby complying with the conditions imposed by the appellate Court for granting the stay of the conviction under Section 138 of the Negotiable Instruments Act. In view of this, the petitioner is permitted to file a fresh application and furnish the demand draft before the appellate Court.

HC-KAR NC: 2025:KHC:35250 CRL.P No. 10235 of 2025
3. As the petitioner has expressed willingness to deposit 20% of the fine amount along with the required surety, the appellate Court is directed to take a lenient view, extend the time for deposit of the fine amount, and thereafter proceed to hear the appeal on its merits.
4. Accordingly, without expressing any opinion on the merits of the case, the captioned petition stands disposed of. Sd/- (SACHIN SHANKAR MAGADUM) JUDGE
