GP MUNCIPAL ADMN AND URBAN DEV AP The Court made the following: 2 ORDER : The Writ Petition is filed under Article 226 of the Constitution of India to declare the inaction of the 2nd respondent in not taking any action against respondent No.3 for his unauthorized and illegal construction being raised in Plot No.38, Panchayat Raj Employees Colony, Penamaluru (V&M), Vijayawada, despite the complaint dated 19.12.2024 made by the petitioner, as illegal, arbitrary and violative of the provisions of A.P. Building Rules 2017. 2. Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration and Urban Development for respondent No.1 andMs.S.Pranathi, learned Standing Counsel for respondent No.2. 3. Today, when the matter came up for hearing, learned Standing Counsel appearing for respondent No.2 furnished a copy of the letter addressed by respondent No.2 vide File No.MAU61-DP0VIJ(UAC)/-2/2025, dated 20.01.2025 to the Panchayat Secretary, Penamaluru Village, Krishna District requesting them to take appropriate action and submit a report regarding the complaint raised by the petitioner that the unofficial respondent No.3 though has obtained building permission through online APDPMS for construction of stilt + Ground + two upper floors residential building vide B.P.No.1168/1097/B/PMLR/PMLRVLG/2024 in R.S.No.28/5, 28/6, 28/2, 28/1A, 28/3, 29/1 and 29/2 in Plot No38 of L.P.No.6/1999, Panchayat Raj Employees Colony, Penamaluru (V&M), in an extent of 209.13 square meters, has commenced construction in deviation to the approved plan. 3 4. In view of the above instructions, as respondent No.2 has already addressed a letter to the Panchayat Secretary, Penamaluru Village on 20.01.2025, calling for a report, instead of keeping the writ petition pending, this Court feels it appropriate to dispose of the writ petition by directing respondent No.2 to see that appropriate action is initiated as against respondent No.3 herein in accordance with law, if at all it is found that respondent No.3 has deviated from the approved plan, after giving due notice to both respondent No.3 and the petitioner, and conducting an appropriate enquiry in accordance with law. 5. 5. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
