E.P.No.95 of 2022 ABDUL QUDDHOSE.J., Nazir of this Court has submitted a report dated 14.03.2025, stating that, when the Bailiffs had visited the premises of Container Corporation of India Ltd., where the movables belonging to the Judgment Debtor are lying and which were ordered to be attached, they were informed by Mr. Santhosh.V, Teminal Manager of the Container Corporation of India Ltd., that attachment cannot be made and he had given an explanation letter dated 12.03.2025 as to why attachment cannot be made. The explanation letter is also attached along with the report of the Nazir dated 14.03.2025. As seen from the same, the Judgment Debtor has not paid the customs duty in respect of the movables, which was ordered to be attached. 2. Learned counsel for the petitioner, in view of the same, is not pressing this E.P. Further, he seeks liberty for the petitioner / decree holder to file a fresh petition against the property owned by the respondent / Judgment Debtor. Accordingly, this E.P. is closed.
