In this writ petition, the petitioners have sought for following relief/s: “i. Issue writ of Certiorari to quash the notification No.EST-1/E2/NEURUTTI/2020, dated 19.11.2019 issued by the respondent No.2 Bangalore University (so far as the petitioner is concerned) Vide ANNEXURE-G. ii. Issue writ in the nature of mandamus or any other appropriate writ or direction directing the respondent to continue the petitioner in service up to the age of 62 years. iii. Pass such other orders as may be appropriate in the facts and circumstances of the case, in the ends of justice and equity.” - 3 - HC-KAR NC: 2025:KHC:35394 WP No. 7619 of 2020 2. Pursuant to the interim order granted by this Court on 18.06.2020, the petitioner (Dr.Lingaraju T) has completed 62 years of service. Thereafter, he has retired from the service. During the pendency of this writ petition, the petitioner has expired and his legal representatives have come on record. Now, the learned counsel appearing for the petitioners has submitted that, in respect of similarly situated employees, the University has settled their pension. Therefore, he seeks a direction to respondent No.2 to settle the petitioner’s pension in terms of the other employees, such as Prof.K.Lakshmanappa and Prof.G.S. Nagaraj. 3. Learned counsel appearing for the University has submitted that, in this writ petition, the only prayer of the petitioner is to continue service till 62 years. In view of the interim order, he has completed 62 years. No relief has been sought for the settlement of pension. If the petitioner submitted a representation, the same will be considered in accordance with law. - 4 - HC-KAR NC: 2025:KHC:35394 WP No. 7619 of 2020 4. In view of the above, the writ petition is disposed of, reserving liberty to the petitioners to submit a representation for the settlement of pensionary benefits of deceased (Dr.Lingaraju.T), enclosing all the relevant records and judgments. If such a representation is submitted, the respondents shall consider the same and pass an order in accordance with law, within two months from the date of receipt of the representation.
