Court No. - 39 Case :- WRIT - C No. - 15034 of 2025 Petitioner :- Radharaman As Per Aadhar Card, Correct Name Is Radhawar Tiwari Respondent :- Union Of India And 2 Others Counsel for Petitioner :- Nirbhaya Kumar Mishra,Vijeta Tiwari Counsel for Respondent :- A.S.G.I. Hon'ble Arindam Sinha,J. Hon'ble Avnish Saxena,J. The disposed of writ petition has been listed under heading "to be mentioned" pursuant to direction in our order dated 16th May, 2025. We did so at instance of petitioner. Mr. S.K. Shukla, learned advocate appears on behalf of petitioner and submits his client had applied for correction of his name reflected in the Aadhar card, not change of name. Mr. Gopal Verma, learned advocate appears on behalf of Union of India and submits, the only way petitioner can have change of name is by obtaining notification to that effect published in the gazette. Reproduced below are paragraphs 3 and 4 from disposal order dated 13th May, 2025. "3. Petitioner, if applies for publication under relevant rules and thereupon applies for updating information in his Aadhar card, on verification, the information in respect of change of his name be updated in his Aadhar card. 4. The writ petition is disposed of". Petitioner, in effect wants recall of the order citing error, on contention that he had not applied for change but for correction. On query Mr. Verma hands-up his instruction. Reproduced below is paragraph 2 from it. "2. That in regard to the petitioner's submission in para 3 of the writ petition that due to bonafide mistake, petitioner name has wrongly been mentioned as Radharaman in his Aadhaar this fact is absolutely incorrect because as per the UIDAI records, on 30th June, 2017 the petitioner himself changed his name in Aadhaar. Initially at the time of Aadhaar generation petitioner name in the Aadhaar was Radhawar, thereafter on 30th June, 2017 he updated/changed his name in Aadhaar as Radharaman by using Pan Card. The copy of the Enrollment Slip dt 30th June, 2017 is annexed with this note as Annexure No.1". We had made a correct order disposing of the writ petition. Our order dated 13th May, 2025 does not carry any error. On behalf of petitioner we were mislead, causing unnecessary waste of judicial time. Order Date :- 28.5.2025 Ashutosh (Arindam Sinha,J.)
