Saha, learned Additional PP appearing for respondent-State. This is an application filed under section 482 of the BNSS, 2023 for granting anticipatory bail to the applicant in connection with East Agartala Women PS case No. 63 of 2024, registered under Sections 329, 63(iii), 351 of the BNS, 2023. As per the prosecution story, one Smt. Rina Roy lodged written complaint with the Officer-in-Charge of East Agartala Women police station alleging inter alia that at the request of her husband, the applicant-accused came to her rented house for some treatment of her ailing son and after preliminary treatment when her son felt relieved, the applicant stayed in her rented house for that night. It was further alleged that, during his stay at that night, he asked the complainant for some water and when she opened the door, the accused-applicant had forcibly entered into her room and committed rape upon her. It was also alleged that the applicant had taken some nude photographs and also made some nude videography of the complainant through his mobile phone. The complainant further alleged that the applicant had threatened her not to disclose the fact to anybody else he will make her photograph viral in social media and also had demanded Rs. 5 lakhs from the complainant. Mr. Lodh, learned counsel appearing for the applicant, has submitted that the applicant has been falsely implicated with the instant case. Mr. Lodh, learned counsel has further submitted that the applicant is totally innocent. Mr. Saha, learned Additional PP has produce the case diary and fairly submitted that he has seen the videography wherefrom it is revealed that the complainant herself had videographed the same through her mobile. I have meticulously gone through the case diary. From the case diary nothing material has come to fore to establish any offence against the applicant. It is further revealed that whatever relation developed between the accused and the complainant was consensual in nature. In my opinion, life and liberty of a citizen is very precious and it should not be curtailed casually. Considering the matter in its entirety, I am inclined to grant anticipatory bail to the applicant, namely, Suman Saha. Thus, the order dated 12.03.2025 stands confirmed. Accordingly, it is ordered that, in the event of arrest, the applicant, namely, Suman Saha, may be released on bail on executing a bond of Rs. 50,000/- with one surety of the like amount to the satisfaction of the arresting authority. With above observations and directions, the instant anticipatory bail application stands allowed and thus disposed. Return back the case diary.
