W.P.No.16887 of 2025 O R D E R The writ petition has been filed to quash the impugned proceedings of the respondent dated 19.04.2025. 2. According to the petitioner – Manappuram Finance Limited, they received a impugned notice dated 19.04.2025 from the respondent- Police directing them to produce the jewels mentioned in the schedule attached with the said notice for investigation in Crime No.33 of 2025 on the file of the respondent-Police. It is further stated that the respondent-Police registered a case in Crime No.33 of 2025 against two unknown persons for committing theft of jewels from one Lakshmi and the same were handed over to one Selvi, who in turn, pledged the said jewels with the petitioner – Finance Limited in her name. At the time of availing loan, the said Selvi clearly gave an undertaking that the jewels pledged with the petitioner -Finance Limited is her own jewels and based on her undertaking, loan was sanctioned to the said Selvi. However, the respondent-Police, in order to show recovery in the above said case and to fill up the lacuna on investigation are intended to seize the said jewels. W.P.No.16887 of 2025 produced and seized by the respondent-Police, it would cause great loss to the petitioner – Finance Limited. 3. Heard both sides and perused the materials available on record. 4. It is seen from the records that the respondent-Police suspected that some stolen jewels were pledged in the petitioner Institution and that they sent notice to the petitioner to produce the jewels mentioned in the schedule attached with the said notice for investigation in Crime No.33 of 2025 on the file of the respondent-Police.
It is further seen that in this case, investigation is under progress and that pending investigation, this Court cannot go into the merits of the case and decide the ownership of the said property. Therefore, the relief sought for by the petitioner in this writ petition is not maintainable and the same is dismissed. However, the petitioner is directed to produce the said jewels, after taking photographs, before the respondent/Police. After receiving the said jewels, the respondent/Police is directed to produce the same before the jurisdictional Magistrate forthwith.
