The petitioner has been made accused in connection with Gawan P.S. Case No. 54/2024 corresponding to POCSO Case No. 108/2024, for the offences registered under Sections 376(DA), 379 & 506 of the I.P.C. and Sections 4, 6, 8 & 10 of the POCSO Act, pending in the Court of learned Special Judge POCSO Act, Giridih. 3. On 24.05.2024, the petitioner alongwith co-accused intercepted daughter of the informant and her relatives near Gobardaha forest area. It is alleged that the co-accused namely Sukhdeo Tudu raped her while his associates had caught hold of the victim. 4. Learned counsel appearing on behalf of the petitioner submitted that the victim has not named the petitioner. It was further submitted that co-accused Sunil Murmu has been granted bail by this Court earlier. 5. Learned A.P.P. has opposed the prayer for bail of the petitioner and submitted that two witnesses have stated that the petitioner was involved in the said occurrence. It was further submitted that the mobile phone of the victim was recovered from the possession of the petitioner. 6. In view of the aforesaid facts, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected. (Ambuj Nath, J.) Rahul/-
