(At Present Confined In Central Jail Jaipur). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Gajveer Singh Rajawat For Respondent(s) : Mr. Rajesh Choudhary GA cum AAG with Ms. Neha Goyal HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 04/02/2025
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.38/2023 registered at Police Station Special Police Station (SOG), District ATS and SOG for the offence(s) under Sections 419, 420, 467, 468 and 120-B of IPC and Sections 3 and 10 of Rajasthan Public Examination (Measures for Prevention of Unfair Means in Recruitment) Act, 2022.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the other co-accused have already been enlarged on bail and the present petitioner's case is akin to the case of other co-accused. The accused-petitioner is in custody since long and trial/investigation of the case may take
[2025:RJ-JP:4748] (2 of 2) [CRLMB-1596/2025] considerable time, therefore, the bail application of the accused- petitioner may be allowed.
3. Learned GA cum AAG has vehemently opposed the bail application and submitted the factual report. It is contended that it is alleged against the accused-petitioner that he appeared as examinee in place of Durgaram, considering the allegation levelled against the accused-petitioner, the bail application may be dismissed.
4. Heard and perused the material available on record.
5. It is not desirable to express anything on the merits of the case. Considering the fact that the other similarly placed co- accused have already been enlarged on bail by this Court and the matter of the present accused-petitioner is not distinguishable to the case of the other co-accused, therefore, I deem it just and proper to enlarge the accused-petitioner on bail.
6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Deepak Bishnoi S/o Shri Prakash Bishnoi in connection with FIR No.38/2023 registered at Police Station Special Police Station (SOG), District ATS and SOG shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
