1. The petitioner has filed the present writ petition claiming the following relief(s):-
“i. That, The Hon’ble Court may be pleased to call the entire records pertaining the case of petitioner for its kind perusal. Digitally signed by MOHAMMED AADIL KHAN

The Hon’ble court may kindly be pleased to direct the respondent authorities for the consideration of case of the petitioner for promotion to the post of Assist Sub Inspector (M) in the light of letter dated 23/06/1995, 04/01/1997 and the SOP dated 12/10/2006. iii. Any other relief, which this Hon’ble Court deems fit and proper, may also kindly be granted to the petitioner, in the interest of justice. iv. Cost of the petition may also be granted to the petitioner.”

Learned counsel for the petitioner would submit that the petitioner is appointed on compassionate ground vide order dated 21-08-2017 and has been posted to Police Training Institute Rajnandgaon. During her service she did her graduation and Diploma in Computer Application examination and has completed about eight years of her service as Constable (M). There is a circular of State Government dated 23-06-1995, 04-01-1997 and SOP dated 12-10-2006 and in view of those circulars she is also entitled for promotion on the post of Assistant Sub Inspector (M) in the department after successfully completion of five years of service. The other similarly situated employees have been given promotion on the post of Assistant Sub Inspector (M). However, despite making her representation the petitioner has not been given promotion on the said post. He would further submit that with respect to claim of the petitioner, she has made her representation on 02-11- 2022, 09-08-2023 and 30-07-2024 (Annexure-P/4), but till date her representation has not been considered, therefore, respondent No.4 may be
directed to consider the representation of the petitioner and to pass appropriate order in accordance with law and as per applicable rules and circulars of the department holding the field within a stipulated time-frame.

3. On the other hand, learned counsel for the State has not objection if such direction is made to the respondent No.4 to take a decision on the pending representation of the petitioner in accordance with law.

Considering the submissions made by learned counsel for the parties, the present writ petition is disposed of directing respondent No.4 to take a decision on the pending representation of the petitioner dated 02-11-2022, 09-08-2023 and 30-07-2024 keeping in view these three circulars dated 23- 06-1995, 04-01-1997 and SOP dated 12-10-2006 in accordance with law and also under the applicable rules and circulars of the department holding the field within 90 days from the date of receipt of copy of this order.
5. The petitioner is directed to produce a copy of this order to respondent No.4 within two weeks from today.
