GP FOR PANCHAYAT RAJ RURAL DEV The Court made the following: RC,J W.P.No.12733 of 2023 4 ORDER This writ petition is filed questioning the action of the respondent nos.2 to 4 in attempting to lay road in the petitioner’s private land in Survey No.951/2, 961/1 and 961/3 of Dudyala Village fields, Sambepalli Mandal, Annamayya District. 2. Sri Balakrishna, learned Assistant Government Pleader for Panchayat Raj, on written instructions dated 01.07.2023 of the Executive Engineer, Panchayat Raj Department, Rayachoty, Annamayya District, submitted that there is no sanction order from the District Collector for laying the subject road and further there is no resolution of Gram Panchayat for laying the road as alleged by the petitioner. 3. Sri V.R.Reddy Kovvuri, learned counsel for the petitioner, submitted that this writ petition may be closed recording the contents of the written instructions. 4. In view of the submissions made by learned Assistant Government Pleader that there is no resolution of Gram panchayat for laying the road, this writ petition can be closed. RC,J W.P.No.12733 of 2023 5 5. Accordingly, the writ petition is closed. It is needless to observe that in future if Grampanchayat proposes to lay road in the subject property, they have to follow due process of law. There shall be no order as to costs.
