JUSTICE E.S.INDIRESH ORAL ORDER This application is filed under Section 460(6) of the Companies Act, 1956, read with Rule 6 and 9 and Rule 164 of the Companies (Court) Rules, 1959. 2. In this application, the applicant being a dismissed employee of the respondent No.2, is - 3 - HC-KAR NC: 2025:KHC:32783 CA No. 345 of 2017 IN COP NO.154 of 2002 questioning the order dated 22.11.2000, dismissing the applicant along with Article of Charges (Annexure- N) and to release the advance or part payment up to 50% or half of the Debt-Claim pending as per Annexure-C to the application. 3. In this regard, the statement of objections are filed by the respondent No.2, stating that the order of dismissal passed by the respondent No.2 is confirmed by this Court in W.P.No.14498 of 2016 dated 19.07.2016 and in W.A.No.3962 of 2016 dated 30.05.2017. 4. Having taken note of the submission made by Sri. B. Ramesh, learned counsel for the petitioner and Sri. Saji P. John, learned counsel for the respondent Nos.1 and 2, wherein this Court has already confirmed the order of dismissal passed by the respondent-Statutory body and same has reached - 4 - HC-KAR NC: 2025:KHC:32783 CA No. 345 of 2017 IN COP NO.154 of 2002 finality and therefore, in view of the confirmation made by this court in W.P.No.14498 of 2016 dated 19.07.2016 and in W.A.No.3962 of 2016 dated 30.05.2017, I am of the opinion that, CA No.345 of 2017 does not survive for consideration.
