Mr. Saurabh Kumar Pandey, learned counsel for the applicants. 2. Mr. Siddhartha Bisht, learned AGA along with Mr. N.S. Kanyal, learned AGA for the State. 3. Present applicant–Sandeep Chaudhary S/o Balveer Singh Chaudhary and Manish Chauhan S/o Suresh Singh are seeking regular bail in relation to first information report dated 14.03.2025 bearing FIR No. 0081 of 2025, Police Station Kotwali Kotdwar, District Pauri Garhwal, wherein the present applicants have been implicated for the offences punishable under Sections 3(5), 61(2), 109, 115(2), 352 of B.N.S, 2023 and Section 3/25 of the Arms Act. 4. Learned counsel for the applicants submits that the present applicants are innocent and have been falsely implicated, which is evident from the fact that this is a case of no injury. 5. He further submits that after completion of the investigation, the charge- sheet has been filed and four persons including the present applicants were charge-sheeted and the two other co- accused, who were charge-sheeted, namely, Pankaj Negi and Arjun Kandwal alias Kaka have already been granted bail on 29.03.2025 by the trial Court. He also submits that the present applicants have no previous criminal history and since the charge-sheet has been filed, there is no need of custodial interrogation of the present applicants. 2025:UHC:4884 6. On the other side, Mr. Siddhartha Bisht, learned AAG, have not disputed this fact that the charge-sheet has been filed against the four persons and the two co- accused persons have already been granted bail by the trial Court and the present applicants have no previous criminal history. 7. After hearing the arguments as advanced by learned counsel for the parties and further taking into consideration that the charge-sheet has already been filed and the two co-accused persons have already been granted bail by the trial Court on 29.03.2025, this Court is of the view that the present applicants deserve for bail particularly keeping in view of the fact that the present applicants have no previous criminal history. 8. Accordingly, without expressing any opinion on the merit of the case, the present bail application is allowed. 9. Let the applicants, namely, Sandeep Chaudhary and Manish Chauhan, be released on bail, on their executing personal bond and furnishing two reliable sureties, each in the like amount, by each of them, to the satisfaction of the court concerned.
