2. The case of the prosecution is that the accused/A5 & A4 had committed theft of 60 sovereigns of gold jewels and a sum of Rs.10,000/- from the de facto complainant's house. Hence the case. 3. The contention of the learned counsel appearing for the petitioners is that the petitioners are innocent and have been falsely implicated in the present case. He further submitted that the petitioners have nothing to do with the alleged offence and since their family members were involved in this offence, the petitioners have also been implicated in this case. He further submitted that the petitioners are ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail. 4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and opposed for granting anticipatory bail to the petitioner. He further submitted that out of 60 sovereigns of gold jewels, only 10 sovereigns were recovered and remaining are yet to be recovered. He further submitted that the petitioners actively participated in the commission of the offence by identifying the house and conveying the same to the other accused. 5. Considering the submissions made by the learned counsel appearing on either side and taking note of the serious nature of the allegations and that balance jewels have to be recovered, this Court is of the view that the custodial interrogation of the petitioners is necessary in this case. Therefore, this Court is not inclined to grant anticipatory bail to the petitioners. 7. Accordingly, the Criminal Original Petition stands dismissed. 02.07.2025 ham To
