Learned counsel for the petitioner submits that earlier the petitioner was before this Court in W.P.No.22875/2021 aggrieved of the rejection of the applications for regularization of unauthorized occupation of 02 acres and 22 guntas of land in Sy.No.15 of Maratekyathanahalli Village, Jayapura Hobli, Mysuru Taluk. - 3 - HC-KAR NC: 2025:KHC:39036 WP No. 27922 of 2025 This Court disposed of the writ petition by order dated 20.01.2022 with a direction to the Tahsildar to consider the application filed by the petitioner, having regard to the orders passed earlier in W.P.No.46674/2012. 3. However, since it was found that the said lands are within the prohibited distance from the boundary of Mysuru City Corporation, the Deputy Commissioner, Mysuru District directed the Tahsildar by a communication dated 27.05.2024 at Annexure-S, that an alternative land with a same measurement either in Sy.No.125 of Dadadakallahalli Village or Sy.No.162 of Nagavala Village may be granted to the petitioner. The Tahsildar had directed the Deputy Tahsildar to enquire and submit a report as to whether the said lands can be granted to the petitioner. The Deputy Tahsildar by communication dated 18.12.2024 at Annexure-T submitted a report to the Tahsildar that the land in Sy.No.125 of Dadadakallahalli Village is not within the prohibited distance and therefore, the same can be granted to the petitioner. - 4 - HC-KAR NC: 2025:KHC:39036 WP No. 27922 of 2025 4. Learned counsel for the petitioner submits that, despite such a communication being made in the month of December, 2024, the Tahsildar has not proceeded to grant the land in favour of the petitioner. 5. In that view of the matter, the writ petition stands disposed of, with a specific direction to respondent No.2 - Tahsildar and respondent No.4 - Deputy Commissioner, Mysuru District to ensure that, 02 acres and 22 guntas of land in Sy.No.125 of Dadadakallahalli Village, Ilavala Hobli, Mysuru is granted to the petitioner as expeditiously as possible and at any rate within the period of three months from the date of receipt of a copy of this order.
