By way of this writ petition, the petitioner has prayed for the following reliefs:- a) That a writ of mandamus be issued against the official respondents directing them to demolish the structure in question at the earliest;

In light of the order which the Court is going to pass, as no orders adverse to the interest of un-served respondents is being passed, therefore, the Court is not insisting upon the petitioner to

serve them.

This petition is disposed of with the direction that let the petitioner file a fresh application to the Authority concerned highlighting therein the grievance raised in this writ petition and such application of the petitioner be decided by the Authority concerned within a period of eight weeks from the date of receipt thereof, by complying with the principles of natural justice, i.e. after giving opportunity of hearing to the parties concerned. It is clarified that this Court has not made any observation as far as the merit of the issue is concerned and the same shall be decided by the Authority purely on its merit, uninfluenced of any observation made by this Court while disposing of this petition. Pending miscellaneous applications, if any, also stand disposed of.
