1. On 22.05.2026, this Court in view of order dated 6th April, 2026, passed in SLP 11077-11079/2025, requested Director, AIIMS to have the vision of the petitioner examined by a panel of Ophthalmologists, so as to ascertain the Ophthalmological defect, if any, including the defect of colour vision. 2. The Medical Board was constituted and accordingly examined the petitioner on 20th June, 2026. The report of the Medical Board is handed up in Court taken on record, which reads thus:- This is a digitally signed order. 3. In the wake of above, it is amply clear that colour vision of the petitioner is within normal limits. This is a digitally signed order. Once it is certified by the expert Medical Board that the colour vision of the petitioner is within normal limits, the decision of the Medical Board of the respondents, in such an eventuality, stood overruled. 5. As such, in the light of the Apex Court order referred above and the subsequent order dated 15th April, 2026, we deem it appropriate to pass the following order:- a. Having regard to the final impression of the expert Medical Board constituted by the AIIMS, we hold that the petitioner is entitled for the relief as claimed in the petition; b. Consequently, the impugned orders dated 11.02.2025 and 02.07.2025 are hereby set aside; c. The petitioner, namely Mr.
Sani Chetry, shall present himself before the competent authority of CISF, within a period of 15 days from the date of receipt of the order and the respondents, thereafter, shall offer appointment to the petitioner, by enrolling him as a member of CISF, subject to compliance with all other formalities, including successful completion of training; d. In view of the fact that the delay in the matter of joining of the petitioner cannot be attributed to him, it is likely to note his seniority vis-a-vis other members of his batch; e. As such, it is made clear that upon appointment/enrollment of the petitioner, he shall be entitled to notional seniority from the date the others in his batch were appointed/enrolled, as per the rules. However, we make it clear that the petitioner shall not be entitled for any back wages for the said period. 6. The petition stands allowed and disposed of in above terms.
