LEGAL AID The Court made the following: ...RESPONDENT/COMPLAINANT(S) ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioner/Accused for granting of pre-arrest bail in connection with Crime No. 166 of 2025 of Nandigama Police Station, NTR District, registered for the 2 alleged offence punishable under Sections 318(2) and 69 of the Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’). 2. Heard the learned counsel for the petitioner, the learned Assistant Public Prosecutor. 3. The petitioner is aged about 32 years and was recently married. Respondent No. 2/defacto complainant is aged about 44 years. The defacto complainant, who is a software engineer residing in Texas, USA, submitted a formal complaint against the petitioner alleging that he had exploited her both emotionally and physically. It is alleged that the petitioner misled and took advantage of several women by misusing his position as a lecturer and by making false promises of marriage. The petitioner is a qualified Chartered Accountant and was employed as a faculty member at Master Minds Educational Institute. The defacto complainant alleged that the petitioner expressed his intention to marry her and had physical relations with her at Treebo Abhi Suites Hostel, Arundalpet, Guntur, and also at his friend’s residence, under the false pretext of marriage. The defacto complainant further stated that one Kuchi Nagini was also deceived by the petitioner. When the defacto complainant confronted the petitioner, he convinced her by denying the allegations while continuing his relationship with Nagini. During the course of their relationship, the petitioner is said to have taken an amount of Rs.2,50,000/- from the defacto complainant and later refused to return it. 3 4. On 16.05.2025, Kuchi Nagini lodged a complaint before the Station House Officer, L.B. Nagar Police Station, Rachakonda Commissionerate, stating that she had married the petitioner. As the parents of Nagini were not willing to accept their marriage, they lodged a theft case against Nagini, her husband (the petitioner), and her family members. The petitioner filed a marriage certificate issued by Arya Samaj, dated 06.05.2025, along with photographs of himself and Nagini. Further, one M. Narasimha Rao lodged a report vide FIR No. 158 of 2025, dated 08.05.2025, for the offence punishable under Section 305(a) of ‘the BNS’ against the petitioner and his wife, Nagini. The petitioner is a permanent resident of Nalgonda District. He has got fixed abode. I \ Considering the facts and circumstances, the gravity and nature of the allegations levelled the Petitioner, this Court is inclined to grant pre-arrest bail 5. to the Petitioner/ Accused. 6. In the result, the Criminal Petition is allowed with the following conditions: i. In the event of arrest of the Petitioner/Accused, he shall be enlarged on bail subject to he executing a bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only), with two sureties for the like sum each to the satisfaction of the arresting police officials: , 4 ii. The Petitioner/Accused shall make himself available for trial and when required; as iii. The Petitioner/Accused shall not oause any threat, inducement or promise to the prosecution Witnesses.
