7/02.09.2025 Heard learned counsel appearing on behalf of Petitioners and learned APP appearing on behalf of the State.
2. The petitioners are apprehending their arrest in connection with Bokaro Sector-12, P.S. Case No.68 of 2023, for the alleged offences registered under Sections 341, 323, 325, 354, 379, 307, 504, 506/34 of IPC, pending in the Court of learned Judicial Magistrate, 1st Class cum Civil Judge Junior Division, Bokaro.

Learned counsel appearing for the petitioners submits that there

are case and counter case between the parties. He further submits that late Guneshwar Prasad Sinha had three sons and a married daughter, who reside at different places. The married daughter namely Anju Sharma lives at Patna in her in laws house with her husband Arvind Sharma @ Arvind Kumar Sharma. He submits that petitioner no.1, namely, Abhay Kumar is employed at Patna and his wife, who is petitioner No.2 is a school teacher and she resides at Bokaro. He further submits that petitioner Nos.1 & 2 are brother-in-law and sister-in-law of the informant and the petitioner No.3 to 6 are sister- in-law and nephews. He further submits that false allegations are made against the petitioners. He submits that all the petitioners have come to see the ailing mother, who is aged about 85 years and the informant and her husband were not taking care of the ailing mother and the petitioners were very much concerned with the treatment of the mother and for that the altercation took place.

Learned counsel for the State opposed the prayer and submits that the injuries are found to be grievous in nature.

In view of above and considering that there are case and counter case between the parties and allegations are made that the informant was not taking care of her ailing mother aged about 85 years and petitioner No.1 & 2 are residing at Patna and Bokaro and petitioner No.3 to 6 are residing at Patna and it appears that there are general and omnibus allegations against the petitioners and in the aforesaid backgrounds, the altercations took place, I am inclined to grant anticipatory bail to the petitioners.

Accordingly, the petitioners above named are directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of their surrender / arrest, they shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) each with two sureties of the like amount of each to the satisfaction of learned Judicial Magistrate, 1st Class cum Civil Judge Junior Division, Bokaro, in connection with Bokaro Sector-12, P.S. Case No.68 of 2023, subject to the condition as laid down under Section 482(2) of Bhartiya Nagarik Suraksha Sanhita,

7. This Anticipatory Bail Application is accordingly allowed and
disposed of.
