The instant Criminal Petition under Section 528 Bharatiya Nagarik Suraksha Sanhita Act, 2023(for short ‘BNSS act’) has been filed, by the petitioner/accused, seeking to quash the proceedings against him in C.C.No.3953 of 2023 on the file of the Principal Junior Civil Judge cum Judicial Magistrate of First Class, East Godavari District for the offence punishable under Section 448, 354-A, 354-D, 506 IPC. 2. I.A. No. 1 of 2025 is filed by the petitioner/respondent No. 1 seeking permission to permit the petitioner/accused to compound the offences punishable under Sections 448, 354-A, 354-D, 506 IPC. 3.
I.A. No. 2 of 2025 is filed by the petitioner/respondent No. 1 seeking to compound the offences against the sole accused in C.C.No.3953 of 2023 on the file of the Principal Junior Civil Judge cum Judicial Magistrate of First Class, East Godavari District. 4. Today, when the matter was taken up for hearing, the petitioner/accused and respondent No. 1/de-facto complainant were present before this Court. They produced their respective attested copies of Aadhar cards in proof of their identity, and the same were placed on record for proper identification. Both the learned counsel on record identified both the parties in open Court. 5. Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor for the State, is in attendance and reported no objection to recording the compromise. 6. This Court enquired the de-facto complainant about her willingness to enter into a compromise in the matter. She represented before the Court that she has voluntarily come forward for the compromise. The de-facto complainant further represented that the case may be closed against the accused. She does not want to prosecute the matter. 7. Considering the submissions and in the light of the judgment of the Hon’ble Apex Court in Gian Singh vs. State of Punjab and another1, since there is an amicable settlement between the parties, in the interest of justice, I.A. Nos. 1 and 2 of 2025 are allowed. Consequently, the Criminal Petition is allowed, and the case against the accused in C.C.No.3953 of 2023 on the file of the Principal Junior Civil Judge cum Judicial Magistrate of First Class, East Godavari District for the offence punishable under Section 448, 354-A, 354-D, 506 IPC, is hereby quashed.
