09 /09.01.2025: The learned counsel for the petitioner submits that since the similarly situated employees after dismissal had challenged the order before the appellate authority, the petitioner also be given liberty to challenge the order of punishment imposed upon him before the Appellate Authority.
2. The learned counsel appearing on behalf of the Ranchi Municipal Corporation has got no objection.
3. Considering the said submission, this writ petition is allowed to be withdrawn with a liberty to the petitioner to approach the Appellate Authority by filing a regular departmental appeal against the order of punishment.
4. If the said appeal is filed, a reasoned order would be passed considering all the documents which the petitioner annexes along with the appeal.
5. The said appeal should be disposed of on merits and not on the ground of limitation.
