(At Present Confined In Central Jail, Jaipur). ----Accused-Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Majhar Hussain For Respondent(s) : Mr. Vivek Sharma, AGA HON'BLE MR. JUSTICE MANEESH SHARMA
Order 27/05/2025
1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of the accused-petitioner, who has been arrested in connection with FIR No.44/2025 registered at Police Station Muhana, District Jaipur City (South) for the offences punishable under Sections 109(1) of BNS, 2023 and 3/25 of Arms Act, 1959 (amended 2019).
2.
Learned counsel for the accused-petitioner submits that the petitioner and complainant are relatives and petitioner has falsely been implicated in the present case. He further submits that the petitioner is in custody since 16.01.2025; the charge-sheet has already been filed and the trial of the case will take considerable time; therefore, further custody of the accused-petitioner would not serve any fruitful purpose, so the petitioner be released on bail.
[2025:RJ-JP:22236] (2 of 2) [CRLMB-1675/2025]
3. Learned Additional Government Advocate has opposed the
submissions made by the learned counsel for the petitioner.
4. Heard learned counsel for both the parties and perused the material available on record.
5. Having considered the facts and circumstances of the case and considering the arguments so advanced by the learned counsel for both parties, considering the fact that the case has been registered on Parcha Bayan of the complainant; there is a direct allegation of causing firearm injury against the petitioner, which is also corroborated from the medical reports available on record, so, looking to the gravity of the offence and nature of allegations levelled against the accused-petitioner, I do not consider it a fit case for grant of bail to the accused-petitioners.
6. Accordingly, instant bail application is hereby dismissed.
7. The observations made hereinabove is only for the decision of the instant bail application and would not have any impact on the trial of the case in any manner.
