HEMALEKHA ORAL ORDER The petitioner has approached this Court seeking to quash the letter dated 21.08.2025 (Annexure-M) issued by respondent No.3, whereby power supply has been sanctioned to the residential property of respondent No.5 for running industrial activities and further directing respondent No.3 to consider his representations dated 17.08.2023 (Annexure-A), 09.08.2024 (Annexure-D) and 07.04.2025 (Annexure-E). 2. The grievance of the petitioner is that, respondent No.5 though sanctioned an electricity connection under Tariff LT2(a) for domestic use, respondent No.5 has installed LT5 tariff and is illegally running an industrial unit in a residential area without obtaining requisite NOC from the competent authorities. - 4 - HC-KAR NC: 2025:KHC:48129 WP No. 34639 of 2025 3. Learned counsel for the petitioner contended that the petitioner being a senior citizen residing in their locality along with several other residents, has reportedly complained to the BESCOM stating that the industrial activity of respondent No.5 is causing substantial noise and air pollution, adversely affecting the neighbourhood. On this basis, the petitioner seeks a direction to respondent No.3 to disconnect the electricity supply to the premises of respondent No.5. 4. The relief sought by the petitioner cannot be granted in the present proceedings. The petitioner has not challenged the sanction or the permission, if any, granted to respondent No.5 for carrying on the industrial activity. A mere representation seeking disconnection of electricity supply cannot be a basis for issuance of a writ of mandamus, particularly when the prayer is beyond the scope of writ jurisdiction in the absence of challenge to the foundational orders permitting such activity. The writ - 5 - HC-KAR NC: 2025:KHC:48129 WP No. 34639 of 2025 petition is not maintainable. Accordingly, the writ petition stands dismissed as devoid of merits.
