PUBLIC PROSECUTOR The Court made the following: 2 THE HONOURABLE SRI JUSTICE HARINATH.N CRIMINAL PETITION NO: 1158/2025 ORDER: The present Criminal Petition is filed by the petitioner/Accused No.2, under Section 528 of Bharatiya Nagarik Suraksha Sanhita Act, 2023, seeking permission to stay at U.S.A for a further period of six (06) months to over-see her son’s cancer treatment. The petitioner is arrayed as accused in Crime No. 132 of 2020 on the file of the Disha Police Station, Vijayawada, for the alleged offences under Section 498-A of Indian Penal Code, 1860 and Sections 3 & 4 of Dowry Prohibition Act, 1961. 2. Learned counsel for the petitioner submits that this Court while disposing of the Criminal Petition No.4116 of 2024, the Trial Court is directed to release the passport of the petitioner/Accused No.2 into interim custody of the petitioner for a period of six (06) months for enabling the petitioner to travel abroad. However, the trial Court to ensure the presence of the petitioner for trial of the case and required the petitioner to give a security of Rs.5,00,000/- as a pre-condition for release of the passport. The petitioner was also directed to furnish travel details to the Trial Court. 3 3. Learned counsel for the petitioner submits that the petitioner has submitted the relevant documents before the appropriate authority at U.S.A for extension of her stay and placed on record, the medical record of her son. 4. With these observations, the present Criminal Petition is allowed and the time granted by this Court in Crl.P.No.4116 of 2024 is extended by a period of eight (08) months from today, and the stay of the petitioner at U.S.A would be subject to approval from the competent authority at USA.
