GP FOR HOME The Court made the following: THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 20037/2023 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue an appropriate writ or order more particularly one in the nature of Writ of Mandamus declaring the action of the respondents especially respondent No.4/Station House Officer in not registering the case for suitable offences against the 5th respondent, who threatened and instigated the petitioner's wife to commit suicide, in pursuance of his complaint dated 8.05.2023 and legal notice dated 27.06.2023, as illegal, arbitrary and against the principles of natural justice and against their obligatory duties and consequently direct the 4th respondent to register the case for suitable offences against the 5th respondent, who threatened and instigated the petitioner's wife to commit suicide, in pursuance of his complaint dated 8.05.2023 and legal notice dated 27.06.2023and to pass…” 2. Heard Sri G Raju, learned counsel for the petitioner and Sri V.Farooq, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner would submit that despite lodging a complaint dated 08.05.2023, respondent No.4 failed to register a case against the 5th respondent for suitable offences. 4. On the other hand, learned Assistant Government Pleader for Home, on written instructions, would submit that the wife of the petitioner expired during the course of treatment. On a complaint lodged by the father of the deceased, case in Crime No.60 of 2023 under Section 174 Cr.P.C. was registered on 12.04.2023 as a suspicious death. After conducting enquiry, the said case was closed. It is further submitted that the police are ready to proceed further in accordance with law if any additional material or information is furnished relating to the death of the victim. 5. Learned counsel for the petitioner submitted that recording the said submission, appropriate orders may be passed. 6. Recording the above submissions, this Writ Petition is disposed of, granting liberty to the petitioner to approach the respondent police and furnish any material or information available with him, whereupon the police shall consider the same and proceed further in accordance with law. There shall be no order as to costs.
