HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. BAIL APPLICATION No. - 15675 of 2025 Court No. - 67 HON'BLE SANJAY KUMAR SINGH, J. Heard learned counsel for the applicant and learned Additional Government Advocate representing the State. The instant bail application has been filed on behalf of the applicant with a prayer to release him on bail in Case Crime No. 170 of 2025, under Sections 190, 191(2), 115(2), 109(1), 352, 351(3) of B.N.S., police station Kotwali Khalilabad, district Sant Kabir Nagar, during the pendency of trial. It is argued by learned counsel for the applicant that F.I.R. has been lodged by complainant Satendra Yadav, who is injured also, on 27.02.2025 against Satyam, Shivam and 10 unknown persons making allegation inter alia that a dispute arose over filling of petrol at the petrol pump. Allegation has been levelled that accused persons in collusion with each other with common intention badly beaten the complainant whereby he got injured. It is also submitted that in the F.I.R., general role of assault has been assigned to all the accused but the injured in his statement has assigned the role of causing injury on his head with helmet to Abhay Kumar. In this regard, referring the injury report of the injured, it is argued that injured has received total seven injuries and as per opinion of the doctor, all the injuries are simple in nature except injury no. 7, which is in the nature of contusion on mid of head of the injured but in CT scan report, no obvious bony fracture and no obvious intra/extra-axial collection seen Versus Counsel for Applicant(s) : Indrakesh Kumar Sharma Counsel for Opposite Party(s) : G.A. Satyam Alias Satyam Kumar .....Applicant(s) State of U.P. .....Opposite Party(s)
and brain of the injured was found to be normal. It is further pointed out that co-accused Abhay Kumar has been granted bail by this Court vide order dated 26.08.2025 in Criminal Misc. Bail Application No. 22545 of 2025, therefore, the applicant is also entitled to be released on bail. The applicant does not have any criminal history to his credit. Lastly, it is submitted that there is no chance of the applicant fleeing away from the judicial process or tampering with the prosecution evidence.
The applicant is languishing in jail since 20.03.2025 and in case, the applicant is released on bail, he will not misuse the liberty of bail and cooperate with the trial. Per contra, learned Additional Government Advocate for the State opposed the prayer for bail of the applicant but could not dispute the above factual aspect of the matter as argued on behalf of the applicant. Having heard learned counsel for the parties and examined the matter in its entirety, I find that co-accused Abhay Kumar who was attributed the role of causing head injury to the injured has been granted bail as noted above, therefore, as per statement of the injured, the case of the applicant stands on better footing to that of co-accused Abhay Kumar, hence prima facie the applicant has made out a case for bail on the ground of parity. Accordingly, the bail application is hereby allowed. Let the applicant-Satyam Alias Satyam Kumar, be released on bail in the aforesaid case crime number on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions:- (i) That the applicant shall cooperate in the expeditious disposal of the trial and shall regularly attend the court unless inevitable. (ii) That the applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer or tamper with the evidence. BAIL No. 15675 of 2025 2
(iii) That after his release, the applicant shall not involve in any criminal activity. (iv) The identity, status and residential proof of sureties will be verified by court concerned. In case of breach of any of the conditions mentioned above, court concerned will be at liberty to cancel the bail.
