The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.377/2025, registered at Police Station Chhawani, District Durg (C.G) for alleged commission of offence punishable under Sections 109, 296, 351(3), 115(2), 3(5) of Bhartiya Nyaya Sanhita, 2023. Case of the prosecution, in brief, that a complaint has been lodged by Dishant Kurre (Complainant) on the premise that on 17.7.2025 at about 8:35 AM he along with his friends was going along to celebrate his birthday party. One Sameer Sao was standing along with friend in the middle of road near Darshan Temple, when asked by the complainant and his friends to remove the vehicles from the middle of the road the brawl took place between the applicant and the complainant along with their friends. The main accused Sameer has hit the complainant with rod along with his friends who have also hit the complainant and his friend Anand. 3. It has been argued by learned counsel for the applicant that the co- accused Samir who is the main accused is said to have caused injuries to the injured Dishan Kurre S/o Pukeshwar Kurre. It is stated that there was a previous animosity between the applicant and the co-accused Samir on account of which he has in his memorandum statement has taken the name of the applicant, therefore he prays to enlarge the applicant on anticipatory bail. 4. Learned State counsel on the other hand has submitted that as per the statement of the injured Dishan Kurre S/o Pukeshwar Kurre whose name has been mentioned as Nishant Kurre S/o Fukeshwar Kurre in the medical examination, has categorically stated in his statement under Section 180 BNS that the co-accused Samir Anand caused injuries to him on his head whereas the applicant was also present along with his other associates who have fled away from the place of occurrence. 3 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the fact that the injured has specifically named the applicant and there was a quarrel between them with respect to parking of vehicle at a Dhaba and the injury has been caused to the injured by a hard and blunt object on the temporal region of head and also considering the fact that investigation is still going on, therefore I am not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the anticipatory bail application of the applicant Vedant Yadav involved in Crime No.377/2025, registered at Police Station Chhawani, District Durg (C.G) for alleged commission of offence punishable under Sections 109, 296, 351(3), 115(2), 3(5) of Bhartiya Nyaya Sanhita, 2023 is rejected.
