A case has been registered against the petitioner herein and others for the offences punishable under Section 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short lthe NDPS Act'). 3. The case of the prosecution in brief 'ls that: On 07.ll.2024, at about 06.00 AM, the Inspector of Police, Sarpavaram Police Station, along with his staff and mediators, while conducting raid at drainage canal bund near the dumping yard on the outskirts of Ramanayyapeta, Kakinada Rural MandaI, found Al and A2 in possession and illegal transportation of 21 Kgs of Ganja which was fetched by them from A3 and A4. The contraband and other material were seized under cover of a mediators report and a case has been registered against the accused. 4. Heard. Perused the record. €_-=f=-i==f:`® '\ '\ I 5. A perusal of the-ng,aterial on record goes to show that the police seized total 21 Kgs of Ganja from the possession of A.1 and A.2 in two polythene covers. out of the same, the polythene cover seized from the possession of petitioner/A.2 contained 10 Kgs of GanJ-a. The petitioner/A2 was arrested on o7.ll.2024 and since then he is languishing in jail. Learned Assistant Public Prosecutor submits that the investl'gation is completed and charge sheet is not yet filed for want of arrest of remaining accused. 6. In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner/A2 on the following conditions. i) The petitioner/A2 shall be released on bail on his executing Personal bond for Rs.10,000/-(Rupees Ten Thousand only) with two sureties of the like sum each to the satisfaction of the learned specl'al Mobile Judicial Magistrate of First Class, Kakinada. ii) On release, the petitl'oner shall appear before the station House Officer concerned, once in a week i.e. on every saturday between 10.00 am and 01.00 pm, till filing of the charge sheet. 7.
