THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE D K SINGH and HON'BLE MR. JUSTICE RAJESH RAI K ORAL ORDER (PER: HON'BLE MR. The present writ petition has been filed impugning the award dated 28.11.2019 passed by Central Government Industrial Tribunal-cum-Labour Court (for short 'the CGIT') in CR No.21/2011. 2. The respondent was holding the post of Cashier-cum- Clerk in State Bank of Mysore, which on amalgamation is State Bank of India. The Central Government vide order dated 25.05.2011 passed in exercise of the powers conferred under Clause (d) of Sub-Section (1) and Sub- - 3 - HC-KAR NC: 2025:KHC:42556-DB WP No. 2449 of 2021 Section 2(A) of Section 10 of the Industrial Disputes Act, 1947 referred the following Industrial Dispute for adjudication to the CGIT-cum-Labour Court:- "Whether the action of the management of State Bank of Mysore, Region-II, Hassan in inflicting the penalty of reduction of pay by two stages with cumulative effect for four years on Shri.G.B. Ramachandra, Special Assistant, with effect from 18.01.2007, is legal and justified? To what relief the workman is entitled?" 3. The respondent/employee was issued a charge sheet dated 22.08.2005. In the domestic enquiry the charges were found proved against the respondent/employee. The Disciplinary Authority imposed the punishment of bringing down the scale of pay by two stages with cumulative effect for a period of five years. Aggrieved by the said decision of the Disciplinary Authority, the respondent filed an appeal before the Appellate Authority and the Appellate Authority modified the punishment and ordered for reduction of scale of pay by two stages for a period of four years. - 4 - HC-KAR NC: 2025:KHC:42556-DB WP No. 2449 of 2021 4. The said order of Appellate Authority came to be challenged before the CGIT-cum-Labour Court by the respondent. The CGIT vide impugned award has set aside the order of punishment. We have considered the award, which is based on the cogent findings on the basis of the evidence led by the parties. 5. We are of the opinion that CGIT has not committed any error of law or jurisdiction, which requires an interference by this Court in exercise of jurisdiction under Article 227 of the Constitution of India. 6. We find no merit in this writ petition, it is accordingly dismissed. Sd/- (D K SINGH) JUDGE Sd/- (RAJESH RAI K) JUDGE NG List No.: 1 Sl No.: 25
