2025:KER:27768 WP(C) 12310/2025 3 JUDGMENT The 1st petitioner is the father of the 2nd petitioner, who is a minor child born out of the relationship between the 1st petitioner and the 3rd respondent. The petitioners have approached this Court seeking a direction to the 2nd respondent to consider Ext.P3 application for the issue of the passport of the 2nd petitioner without insisting for the personal appearance of the 3rd respondent-mother. The marriage between the 1st petitioner and the 3rd respondent has been dissolved by order dated 10-06-2019 in O.P.No.2703/2018 of the Family Court, Ernakulam. 2. The learned counsel appearing for the 3rd respondent submits that the 3rd respondent has no objection in a passport being issued to the 2nd petitioner. 3. Heard the learned Central Government Counsel also. Having heard the learned counsel appearing for the petitioners, the learned Central Government Counsel appearing for the official respondents and the learned
2025:KER:27768 WP(C) 12310/2025 4 counsel appearing for the 3rd respondent, this writ petition will stand disposed of, directing the 2nd respondent to consider any application that may have been filed for the issue of passport to the 2nd petitioner, in accordance with the law, without undue delay.
If the petitioners require urgent passport for the 2nd petitioner, it will be open to them to apply for the issue of passport by opting the Tatkal scheme. The submission of the learned counsel for the 3rd respondent that the 3rd respondent has no objection is recorded. Since the submission of the 3rd respondent has been recorded by this Court, it will be open to the 2nd respondent to process the application without insisting for any fresh declaration from the 3rd respondent.
