Instant petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023 (BNSS) has been preferred seeking directions to the official respondents No. 2 and 3 to transfer the jail of the under trial prisoner Jacob @ Jacie confined in custody in case FIR (Annexure P-1) as under: - FIR No. Dated Sections Police Station 354 08.09.2023 307, 341, 148, 149, 120-B IPC and (302 IPC added lateron) 25 of the Arms Act City Ferozepur, District Ferozepur 2. Heard. 3. It is submitted by learned counsel for the petitioner that the petitioner being the first cousin of the under trial prisoner who is lodged in Central Jail Mansa, in case FIR as mentioned above, had moved a representation dated 01.05.2025 (Annexure P-2) to respondent PREETI 2025.05.19 17:07 I attest to the accuracy and integrity of this document -2- 124-CRM-M-25736-2025 No. 2 seeking his medical examination and also transfer of the jail, but till date no action has been taken on the said representation. 4. Learned counsel for the petitioner further contends that for the purpose of the present petition, the petitioner will be satisfied if appropriate directions are issued to respondent No. 2 to consider and dispose of the aforesaid representation in accordance with the law in an expeditions manner. 5 Notice of motion. 6. On the asking of the Court, Mr. Jatinder Pal Singh, Sr. DAG Punjab, accepts notice on behalf of the State-respondents No. 1 to 5 and submits that the aforesaid representation shall be considered and disposed of expeditiously in accordance with the law. 7. In the circumstances of the case and without commenting on the merits of the case, the petition is disposed of with the direction to respondent No. 2 to consider the averments made in the representation dated 01.05.2025 (Annexure P-2), to dispose of the same expeditiously under the provisions of the law preferably within a period of 03 weeks from the date of receipt of copy of this order. 8.
