JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by sole accused under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 praying to grant bail in Crime No.443/2025 of Varthur Police Station registered for the offence punishable under Section 103 of BNS, 2023. 2. The learned counsel for the petitioner and the learned Additional State Public Prosecutor for the respondent/state. 3. The learned counsel for the petitioner would contend that, the deceased/Ponam Singh was the wife of this petitioner. The matrimonial relation between petitioner and the deceased was not cordial. On the day of incident - 3 - HC-KAR NC: 2025:KHC:47173 CRL.P No. 14035 of 2025 the deceased locked herself in a room and committed suicide. The petitioner broke open the door, and untied the hanging deceased, and intimated her relatives. The post mortem report is unconclusive. The petitioner is having two children to look after. With this, he prayed to allow the petition. 4. Per contra, the learned Additional State Public Prosecutor for the respondent/State would contend that, the voluntary statement of the petitioner clearly indicates that, he has committed murder of his wife. The post mortem report indicates ligature mark on the neck of the deceased, and there are fourteen external injuries over different parts of the body of the deceased. The final opinion is kept pending till receipt of FSL report. The investigation is in progress. If the petitioner is granted bail at this stage, he will hamper the investigation and tamper the prosecution witnesses. Having heard the learned counsel, the Court has perused the FIR, complaint and other materials placed on record. 6. The petitioner is the husband of the deceased/Poonam Singh. Their marriage had taken place in the year 2020, and they have two minor children. The matrimonial relation between the petitioner and his wife was not cordial. The dead body of the deceased was found in the house of the petitioner. The post-mortem report indicates that, there are ligature marks on his neck, and there are fourteen external injuries over different parts of the body. The investigation is in progress. Whether the death of the deceased is either suicidal or homicidal as contended by the learned counsel for the petitioner is a matter to be considered after completion of investigation and filing of charge sheet. The doctor, who conducted post-mortem examination of the dead body of the deceased, has kept his final opinion pending receipt of FSL report. As the investigation is pending, if the petitioner is - 5 - HC-KAR NC: 2025:KHC:47173 CRL.P No. 14035 of 2025 granted bail, there are chances of hampering the investigation and tampering the prosecution witnesses. Therefore, at this stage, the petitioner has not made out any grounds for grant of bail. In the result, the following: ORDER The petition is dismissed.
