HARI HARANADHA SARMA WRIT APPEAL No.1054 of 2024 JUDGMENT:(Per Hon’ble Sri Justice Battu Devanand) This Writ Appeal has been filed against the order dated 10.12.2024 in W.P.No.11558 of 2024 passed by the learned Single Judge of this Court. 2. The facts leading to the filing of present writ appeal are as herein under:- The appellants herein are the writ petitioners in the said writ petition. The said writ petition was filed aggrieved by the action of the Commissioner, Panchayat Raj and Rural Development in issuing the proceedings No.870788/CPR&RD/B3/2019, dated 15.03.2024 effecting promotions to the post of Panchayat Secretary Grade-II, without finalising the seniority list in the cadre of Panchayat Secretary Grade-III in Zone III, stating that the post of Panchayat Secretary is a zonal post and the promotions are pending from the year 2018. 3. The case of the writ petitioners is that they are senior most Panchayat Secretaries working in Zone III and that being so, the respondent No.2 in order to provide promotions to the cadre of Panchayat Secretaries Grade-II from Grade-III has to prepare the seniority list and call for the objections. But the respondent No.2 without calling for any objections has 11 directly issued proceedings impugned in the writ petition. By order dated 10.05.2024, the learned Single Judge has suspended the impugned proceedings on the ground that the impugned proceedings do not indicate that it was a provisional seniority list or it was a final seniority list. In the said writ petition, the respondent Nos.1 and 2 filed vacate petition and respondent Nos.3 to 17 filed an implead petition along with a petition to modify the interim order dated 10.05.2024. The learned Single Judge modified the order and directed the respondent authorities to effect promotions other than the Panchayat Secretaries Grade-III in pursuance of the orders in the writ petition vide order dated 10.12.2024. Aggrieved by the order dated 10.12.2024, allowing the respondent authorities to effect promotions other than the Panchayat Secretaries Grade-III in pursuance of the orders in the writ petition, the writ petitioners filed the present Writ Appeal. 4. The Division Bench of this Court vide order dated 21.12.2024, directed the official respondents to draw all the provisional seniority list by all the Heads of the Departments and publish within four (04) weeks from the date of receipt of copy of that order. This Court also directed the respondents to take objections, if any, for the effected employees within fifteen (15) days from the date of publication of the provisional seniority list. As per the said order, the provisional list shall be displayed on the notice board in the office and also shall be communicated to all the concerned on their WhatsApp Numbers/Messages. If any objections received, they shall be heard and considered within six (06) weeks, thereafter and the final seniority shall be 12 published and based on the said final seniority list four (04) weeks thereafter, promotions to be effected. Final seniority list/promotion list shall be placed before the learned Single Judge before effecting promotions. Thereafter, the respondent Nos.18 to 21 have filed I.A.No.1 of 2025 to implead them as party respondents in the writ appeal and the same was allowed by this Court on 07.04.2025. An application in I.A.No.3 of 2025 was filed seeking to implead the proposed respondents as party respondents in the Writ Appeal and the same was allowed by order dated 07.04.2025. Thereafter, the respondent Nos.18 to 21, 22 to 24, 3 and 7 filed I.A.No.2 of 2025, 4 of 2025 and 5 of 2025 to vacate the order dated 21.12.2024, on the ground that the respondents have prepared a final seniority list dated 29.01.2025 of the Junior Assistants working in the Gram Panchayats after calling for objections on the provisional seniority list, without placing the seniority list before the learned Single Judge as directed and promotions are being undertaken and reversion orders are also being issued. During the pendency of the Writ Appeal, Andhra Pradesh Panchayat Raj Subordinate Service Rules, 2012 were amended vide G.O.Ms.No.65, dated 15.11.2024 and as per the said amendment, the feeder categories for various posts were changed. Considering all these issues, a Coordinate Division Bench of this Court by order dated 09.05.2025 modified the order passed by this Court on 21.12.2024 and directed the official respondents to maintain status quo for a period of eight (08) weeks in all respects and the said order has been extended from time to time to till date. 13 5. Heard learned counsels appearing on either side and carefully perused the material available on record. 6. This appeal is filed against the interim order passed by a learned Single Judge on 10.12.2024 and the main writ petition is still pending. As per the interim direction passed by a Coordinate Division Bench of this Court dated 21.12.2024, the official respondents have to place the final seniority list/promotion list before the learned Single Judge before effecting promotions by following the directions issued in the said order. However, as on today in the light of the status quo orders passed by this Court on 09.05.2025, all proceedings are stalled. 7. In our view, it will cause irreparable loss to the writ petitioners and the unofficial respondents in this writ petition. Instead of keeping this issue pending for years together, it is appropriate to put an end to this litigation by the appropriate Court, as the main writ petition is pending with the learned Single Judge. In our view, it is reasonable and appropriate to request the learned Single Judge to dispose of the writ petition itself on merits, in accordance with law, after giving opportunity to all the parties, as expeditiously as possible, in the interest of both parties. 8. In view of the same, this Writ Appeal is disposed of, requesting the learned Single Judge to dispose of the Writ Petition itself, as expeditiously as possible, in accordance with law. 14 9. Status quo order was passed by a Coordinate Division Bench of this Court on 09.05.2025 in this Writ Appeal. The learned Single Judge is at liberty to pass appropriate orders to continue the status quo orders after hearing both parties, till disposal of the writ petition. There shall be no order as to costs.
