The instant criminal appeal was filed by the appellants being aggrieved by the judgement and order dated 3.3.1983 passed by VII Additional Sessions Judge, Moradabad in Sessions Trial No. 284 of 1981 whereby the appellant no. 1 was convicted under Section 394 IPC read with Section 397 IPC and was sentenced to undergo seven years of rigorous imprisonment. He was further convicted for the offence under Section 25 of Arms Act and was sentenced to undergo two years rigorous imprisonment. By the said order, the appellants no. 2 and 3 were convicted for the offence under Section 394 IPC and were sentenced to undergo seven years rigorous imprisonment. 4. As per the report dated 30.7.2025 received from the Chief Judicial Magistrate, Moradabad, the appellant no.1-Bhullan S/o Kallu had died 25 years ago. The appellant no. 2-Israr S/o Jumma had died 26 years ago and the appellant no. 3-Babbu S/o Abdul Azeej had died 20 years ago. In view thereof, the instant appeal is abated on behalf of all the appellants. 5. Accordingly, the instant criminal appeal is dismissed as abated. 6.
