ORDER:
The instant Writ Petition is filed by the Petitioner seeking indulgence of this Court under Article 226 of the Constitution of India for the following relief:
“.... to a writ, order or direction more particularly one in nature of Writ of Mandamus, declaring the inaction on the part of Respondents 2 and 3 in initiating departmental disciplinary proceedings respectively in pursuance of Representations dated 23-04-2021, 09-09-2020, as against Respondents 7 to 11 for abuse of their official position, failure to do public duty as illegal, arbitrary and consequently direct the Respondents 2 and 3 to initiate necessary departmental disciplinary proceedings as against Respondents 7 to 11 for the misusing their official position ...”
At the time of hearing, learned Government Pleader for Home on oral instructions would submit that no instance as alleged by the Petitioner was occurred and as per the information received from the respondent Police, Petitioner came to the police station in a drunken condition and made galata.
Learned counsel for the Petitioner would submit that since there is a dispute with regard to factual aspect of the matter, liberty may be granted to the Petitioner to file an application before the District Police Complaints Authority.
Learned Assistant Government Pleader would submit that the Court may pass appropriate orders.
In that view, this Writ Petition is disposed of. Petitioner is at liberty to make an application before the District Police Complaints Authority. On receipt of such application, the said Authority shall look into the allegations made against

respondents 7 to 11 and take an appropriate decision over the matter according to law. No order as to costs.
Pending applications, if any, shall stand closed.
