This contempt petition has been filed alleging wilful disobedience of the judgment and order dated 01.05.2025 passed in WPSS No. 1590 of 2020. Operative portion of the said judgment, which allegedly has been violated, is extracted below:- “In this view of the matter, taking parity of the aforesaid judgment and order dated 02.03.2022 passed by the Co-ordinate Bench of this Court which is affirmed by the Division Bench of this Court in Special Appeal vide judgment and order dated 05.03.2024, the writ petition is allowed in terms of the aforesaid judgment and order. The impugned order dated 05.09.2020, passed by respondent no.3 is hereby quashed. The petitioner is entitled to get the approval and her claim for salary on regular pay scale w.e.f. the date of her attaining the qualification of UTETII/CTET-II.” 4. Today, Mr. Devesh Ghildiyal, learned Brief Holder for the State, on instructions, submits that Secretary, School Education Department has taken a decision to absorb the services of the petitioner on the post of Assistant Teacher (L.T. Grade) and necessary directions have been issued to the concerned Chief Education Officer to calculate and release the arrears of salary payable to petitioner. He submits that the arrears, to be paid to the petitioner, shall be released within one month. 5. The contempt petition is, accordingly, disposed of by taking the statement made by learned State Counsel on record. Petitioner shall be at liberty to seek recall of this order, if the payment is not released, within one month.
