GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... to issue an appropriate writ, order or direction more particularly one in the nature of writ of mandamus, declaring that the inaction on the part of the Respondents 1 to 4 in not conducting investigation by adding appropriate section of law in addition to the Section 79, 115(2) of BNS , Section 3(2)(va) of SC and ST POA Act, though other Sections 74,75,76 and 296 of BNS and Section 3(1)(s) and (w) of S.C. and ST POA Act would also attract as per the recitals of the Police Report Dated 13.6.2025 given by the Petitioner to the Respondent N0.4 and consequentially not filing Charge Sheet before the competent Criminal Court of Law in Crime N.O.180 of 2025 Dated 13.06.2025 as per the provisions of Chapter XIII of BNSS corresponding Chapter XII of Cr.P.C, is illegal, arbitrary and unconstitutional.” 2. Heard Sri S.Syam Sunder Rao, learned counsel for the petitioner and Sri Md.Farooq, learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home would submit that the investigation in this case is completed and the charge sheet is also filed for the offences punishable under Sections 79, 115(2) BNS and Section 3(2)(va) of the SCs and the STs (PoA) Act. 4. Recording the said submissions, the Writ Petition is disposed of. However, the petitioner is at liberty to work out her remedies before appropriate forum in accordance with law, if so advised. There shall be no order as to costs.
