ORAL ORDER The petitioner [a borrower] has defaulted in repaying the loan, and the secured creditor has successfully completed auction under the provisions of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 [for short, 'SARFAESI Act']. In fact, the learned counsel for the respondent seeks disposal of the petition in the light of the afore.
Mr. Rishikesh D. M, the learned counsel for the petitioner, submits that the petitioner will work out his remedy under Section 17 of the SARFAESI Act but this Court, to enable the petitioner to pursue such remedy, must call upon the respondent to furnish the details of the sale [including the value for which the property is sold] emphasising that though representations have been given in terms of Annexure - M, the respondent has not disclosed. The petitioner could avail remedy under Section 17 of the SARFAESI

Act but for that, he must have the details. Therefore, the petition stands
disposed of directing the respondent to furnish the details of the sale, including the price for which the property is brought to sale within four [4] weeks from today but observing that this disposal does not inure to the petitioner's advantage insofar as the limitation that could be prescribed in law to avail the alternative remedy.
The petition stands disposed of accordingly.
