Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to may be pleased to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the highhanded action of the 2nd respondent in interfering with the civil disputes and threatened the petitioners with dire consequences to hand over the possession of the agriculture land in Sy.No.77 to an extent of Ac.0.71 cents and in Sy.No.82 to an extent of Ac.0.39 cents situated at China Boddepalli Village, Kotauratla Mandal, Anakapalli District in favour of the 4th respondent pursuant to the Ex-parte Judgment and Decree made in O.S.No.209 of 2021 dated 25.7.2022 on the file of the Principal Junior Civil Judge-cum-Judicial First Class Magistrate Narsipatnam, is highly illegal, arbitrary, and in violation of Articles 14 and 300-A of the Constitution of India and also contrary to the law laid down by this Honourable Court and Hon'bie Apex Court and pass such IA NO: 1 OF 2023 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to direct the 2nd respondent not to interfere into the civil disputes, and not to threaten the petitioners with dire consequences to hand over the possession of the agriculture land in Sy.No.77 to an extent of Ac.0.71 cents and in Sy.No.82 to an extent of Ac.0.39 cents situated at China Boddepalli Village, Kotauratla Mandal, Anakapalli District in favour of the 4th responient pending disposal of the above writ petition and pass such Counsel for the Petitioners: V V N NARAYANA RAO Counsel for the Respondents: GP FOR HOME Counsel for the Respondents:VIJAYA KUMAR NAIDANA The Court made the following order:

ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to may be pleased to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the highhanded action of the 2nd respondent in interfering with the civil disputes and threatened the petitioners with dire consequences to hand over the possession of the agriculture land in Sy.No.77 to an extent of Ac.0.71 cents and in Sy.No.82 to an extent of Ac.0.39 cents situated at China Boddepalli Village, Kotauratla Mandal, Anakapalli District in favour of the 4th respondent pursuant to the Ex-parte Judgment and Decree made in O.S.No.209 of 2021 dated 25.7.2022 on the file of the Principal Junior Civil Judge-cum-Judicial First Class Magistrate Narsipatnam, is highly illegal, arbitrary, and in violation of Articles 14 and 300-A of the Constitution of India and also contrary to the law laid down by this Honourable Court and Hon'bie Apex Court and pass such...…”
2. Heard Sri V.V.N.Narayana Rao, learned Counsel for the petitioners and Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents.

Learned counsel for the petitioners would submit that the respondent police are interfering with the civil disputes and threatened the petitioners with dire consequences to hand over the possession of the agriculture land to the unofficial respondents.
4. Learned Assistant Government Pleader would submit that the police are not interfering in the civil dispute and the Court may pass appropriate orders.
5. Considering the submissions made, this writ petition is disposed of. However the respondent police are directed not to interfere in the civil dispute between the petitioners and the unofficial respondents except under due process of law. There shall be no order as to costs.
