to issue a writ, order or direction more particularly one in the nature of a writ of mandamus declaring the action on the part of the 2nd respondent in not acting on the petitioner's representation, dated 05-07-2022 is as illegal, arbitrary, unjust and violate the fundamental rights guaranteed to the petitioner under Articles 14, 19 and 21 of the Constitution of India and consequently direct the 2nd respondent to conduct departmental enquiry against the 5th respondent in the capacity of the 4th respondent and take necessary departmental action against the 5th respondent in the capacity of the 4th respondent basing on the petitioner's representation dated 05.07.2022 as per the G.O.Ms.No.288 of 2010, dated 06.11.2022, and pass ....”
Heard learned counsel for the Petitioner and learned Assistant Government Pleader for Home appearing for respondent State. Perused the material on record. The grievance of the Petitioner is that respondent Police are calling him to the Police Station and insisting to settle the civil disputes with unofficial respondent. Learned Assistant Government Pleader for Home appearing for respondent Police on instructions would submit that there are money transactions between the petitioner and unofficial respondents with regard to registration of property. The facts of the case clearly establish that the dispute is purely civil in nature and respondent Police never interfered in the matter and would submit that this writ petition may be disposed of by passing appropriate orders. 4
In that view, this Writ Petition is disposed of. Petitioner is at liberty to work out the remedy before appropriate forum according to law. No order as to costs. Pending applications, if any, shall stand closed. DR.JUSTICE VENKATA JYOTHIRMAI PRATAPA Mjl/*
