GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of MANDAMUS declaring the action of the Respondents interfering with the possession and enjoyment of land of an extent of Ac.6-92 cents in Survey No.792-1 AND 792 of Dubhacherla, Nallajerla Mandal, East Godavari District of the petitioner on the pretext of pendency 2 of F.I.R.No.126 of 2025 dt 20-08-2025 on the file of Police Station, Nallajerla for the offences under Sec.292, 296, 143(3) RA/V. 3(5) of BNS, Sec.5(1) (a) PIT Act and Sec.34 (a) of A.P.E.A.as arbitrary, illegal and violative of right to property guaranteed under Article.300-A of the Constitution of India and consequently direct the Respondents not to interfere with the possession and enjoyment of the petitioner's above stated land” 2. Heard Sri Sai Gangadhar Chamarty, learned counsel for the petitioner and Sri Md.Farooq, learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home would submit that the police are not interfering in the lawful possession and enjoyment of the petitioner’s land. It is further submitted that the police have not taken any steps to deprive the petitioner of her property rights. 4. Learned counsel for the petitioner would submit that the Court may pass appropriate orders. 5. In that view, the Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes between the parties except under due process of law. There shall be no order as to costs.
