1. The present Petition has been filed under Articles 226 and 227 of the Constitution of India, 1950, read with Section 151 of the Code of Civil Procedure, 1908, against the Order dated 23.12.2025 passed by the learned Principal District & Sessions Judge, Central District, Tis Hazari, Delhi, in Suit PPA No. 06/2022 titled as “Ramnath Jain & Ors. v. L & DO & Anr.”

Learned counsel appearing for the Petitioners, after arguing for some time, on instructions, seeks to withdraw the present Petition with liberty to take such appropriate remedies as are available to him under law. 3. Leave and liberty, as sought for, are granted.

At this point, after having sought the liberty to withdraw the present Petition in the presence of more than 50 people in the Court, Mr. Praveen Aggarwal, learned counsel for the Petitioners, seeks to contend that his statement regarding the withdrawal can only be recorded in the event that his submissions advanced in the present Petition are also recorded in the order.
5. This Court takes strong exception to the manner in which the
learned counsel is conducting himself. Learned counsel, after having made a categorical statement seeking withdrawal of the present petition with liberty to avail such remedies as may be available to him in accordance with law, cannot thereafter be permitted to impose conditions upon this Court by insisting that such an order would require to be accompanied by the recordal of the submissions made by him. Such conduct is clearly uncalled for and unfortunate.
6. This Court painstakingly reiterates that such a request cannot be entertained. The original order of withdrawal with liberty to avail such remedies as are available to him under law shall stand.
7. Accordingly, the present Petition, along with pending Application(s), if any, stands dismissed as withdrawn.
