50. 04-03-2025 CRM (DB) 205 of 2025 (ct. no.29) S. De In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure as amended under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023. And In the matter of : Md. Tamrej @ Tamrez. …Petitioner. Mr. Amit Roy, ……for the Petitioner. Ms. Minoti Gomes, Mr. Karan Bapuli, ……for the State. Dictated by Arijit Banerjee, J. 1. This case concerns the alleged murder of the Pradhan of Panjipara Panchayat. The allegation is that the petitioner and several other accused persons murdered him in conspiracy with each other. Professional shooters were hired from a neighbouring State. 2. The petitioner says that a co-accused person has been granted bail by this Court. However, we find that that co- accused person and the petitioner are not similarly cirsumstanced. The other person only harboured a criminal and the offence with which he was charged was a bailable offence. 3. The petitioner further says that 3 witnesses have already been examined and none of them takes the name of this petitioner. Learned advocate shows us the deposition. 4. It may be that the 3 witnesses who have been examined so far have not named this petitioner. However, there are 27 2 chargesheet named witnesses. It is too early in the day to say that none of the witnesses will implicate this petitioner. 5. The nature of the crime is serious. We are not inclined to entertain the petitioner’s prayer for bail, at this stage. The trial is in progress. 6. CRM (DB) 205 of 2025 is dismissed. (Prasenjit Biswas, J.) (Arijit Banerjee, J.)
