The Court made the following: ORDER: This Contempt Case is filed under Sections 10 to 12 of Contempt of Courts Act, 1971, for the willful disobedience of the orders dated 20.02.2020 passed in W.P.No.3951 of 2020. 2. Sri T.Bala Swamy, learned counsel submitted that this Court disposed of the writ petition with a direction to respondents not to take any coercive steps, except by due process of law. Pursuant to the said orders, the authority i / concerned has issued a notice invoking the provisions of Andhra Pradesh Land Encroachment Act, 1905, approached the authority and submitted explanation wherein been passed but there was in reply to the same, petitioner has an order has no disobedience on the part of the respondents, the petitioner fiied the present contempt unnecessarily raising allegations against them, accordingly, prayed to dismiss the contempt case. 3. In reply, Ms.Haritha, learned counsel Revathi, learned counsel for the petitioner submitted that the representing Ms.Nimmagadda said notice has been issued pursuant to filing of the contempt case. However, she could not secure latest instructions from the petitioner, as such, prayed to close the contempt. 4. Perused the record and considered the submissions learned counsel for the parties. 5. A perusal of the counter and material available on record would indicate that the authorities have issued a notice under Section 7 of Act, 1905, to which an explanation was submitted by the petitioner and pursuantly Section 6 orders have been passed. It is immaterial as to whether the notice was issued before or after filing this contempt case. It has to be seen whether the authorities are following law or not. It is not the case of the petitioner that he was dispossessed by the authorities without following law. The fact that notice has been issued by the authorities by following law. Therefore, there is no disobedience on the part of the respondents as alleged by the made by the remains / j petitioner in the present contempt case, as such, the contempt is liable to be closed. 6. Accordingly, the Contempt Case is closed. There shall be no order as to costs. As a sequel, miscellaneous applications, pending if any, shall stand closed.
