1. This suit was instituted on behalf of the Plaintiffs inter alia seeking a decree of permanent injunction restraining the Defendant and all others acting on its behalf from manufacturing, stocking, selling and offering for sale Shoe Comp. Brake, Brake Shoes, Die Cast, Disk Clutch Friction, Ball Races Kit, Plug Spark, Cam Chain, Plug Adaptor, engine oils, lubricants or any other product bearing the marks HERO,
and/or any other mark deceptively and confusingly similar to Plaintiffs’ trademarks amounting to infringement. This is a digitally signed order. During the pendency of the suit, parties were referred for mediation before the Delhi High Court Mediation and Conciliation Centre, where they have amicably settled their inter se disputes and a Settlement Agreement dated 30.04.2026 has been executed and signed, incorporating the terms of settlement. Copy of the Settlement Agreement is taken on record. 3. Court has perused the terms of settlement and finds the same to be lawful. Accordingly, the suit is decreed in terms of the Settlement Agreement. As per Clause (vi) of the Settlement Agreement, Defendant is requested to release the goods lying with it under Superdari, which were taken into custody by the Local Commissioner appointed vide order dated 24.02.2025 for destruction. It is thus directed that representative of the Defendant shall hand over custody of the goods to the representative of the Plaintiffs on 21.08.2026 at 02:00 PM. At the time of handing over, inventory shall be prepared and photographs will be taken. Cost of transportation will be borne by the Defendant, as agreed. 4. Registry is directed to draw up the decree sheet. 5. Suit along with pending application stands disposed of. 6.
