Heard learned counsel for petitioner and learned learned counsel for the respondents. 2. The petitioner by means of the present writ petition has prayed for the following relief:- "(1) issue a writ, order or direction in the nature of mandamus directing the respondent No.3 to handover the possession of the leased land situated in Village Bijauli, Tehsil Jhansi, land No.3178, area 0-320 hectare and 3179 (menzumla), area 0-085 hectare, Total land area 0-405 hectare for constructing the RSETI building. (ii) issue a writ, order or direction in the nature of mandamus directing the respondent No.4 to construct the RSETI building in pursuance to the MOU dated 23.03.2022. (iii) issue any other and further order or direction which this Hon'ble Court may deem fit and proper, in the facts and circumstances of the present case. (iv) award the costs to the writ petition in favour of the Petitioner." 3. This Court on 27.08.2025 passed the following order:- "Sri Vineet Pandey, learned counsel for respondent nos.3 & 4 on instructions, which is taken on record, states that there is a stay order operating in respect to the land which has been allotted to the petitioner. Versus Counsel for Petitioner(s) : Sanjai Singh Counsel for Respondent(s) : C.S.C., Vineet Pandey Punjab National Bank .....Petitioner(s) State Of U.P. And 3 Others .....Respondent(s) He is directed to seek instruction in the matter and apprise the Court by the next date fixed as to whether there is any alternative land available with the respondent no.3 which can be allotted to the petitioner. Put up as fresh on 18th September, 2025." 4. Sri Vineet Pandey, learned counsel for respondent nos. 3 & 4 on instruction, which is taken on record that the other land is available with the respondent Nagar Nigam and Nagar Nigam is ready to offer the said land to the petitioner. The instruction dated 15.09.2025 is reproduced herein- below:- "कृ पया मा० उच्च न्यायालय इलाहाबाद में िवचाराधीन िरट यािचका सख्या 14776/2025 पंजाब नेशनल बैंक बनाम स्टेट ऑफ यू०पी० एवं अन्य प्रस्तुत की गई है। उक्त िरट यािचका में आदेश िदनांक 27.08.2005 के क्रम में िनम्नवत अवगत कराना हैः- इस सम्बन्ध में अवगत कराना है िक मौजा िबजौली िस्थत आराजी संख्या 3178 रकबा 0.320 हे0 व 3179 रकबा 0.506 हे0 में से रकवा 0.085 हे0 यािन कु ल 02 िकता रकवा 0.405 है० शासन के िनदेर्शों के क्रम में राष्ट्रीय ग्रामीण आजीिवका िमशन के अन्तगर्त ग्रामीण स्वरोजगार प्रिशक्षण संस्थान की स्थापना हेतु 33 वषर् के िलए पंजाब नेशनल बैंक झाँसी को पट्टे पर दी जा चुकी है। शासन के िनदेर्शानुसार ग्रामीण आजीिवका िमशन के अन्तगर्त भूिम आवंटन िकये गाने के पश्चात उक्त मूिन पर वतर्मान में िनमार्ण कायर् लगभग रू0 1,30,00,000/- (एक करोड़ तीस लाख रूपये) की लागत से िनमार्ण िकया जा चुका है। प्रस्तािवत प्रश्नागत स्थल भूिम के आस-पास राष्ट्रीय ग्रामीण आजीिवका िमशन के अन्तगर्त ग्रामीण स्वरोजगार प्रिशक्षण संस्थान की स्थापना हेतु भूिम उपलब्ध नहीं है। यहां यह भी उल्लेखनीय है िक उक्त तथ्यों के दृिष्टगत पंजाब नेशनल बैंक (आर०एस०ई० टी ०आई०) राष्ट्रीय ग्रामीण आजीिवका िमशन के अन्तगर्त ग्रामीण स्वरोजगार प्रिशक्षण संस्थान की स्थापना अन्य िकसी स्थान पर भूिम चाहे तो उस पर िवचार िकया जा सकता है। अत. उक्त िरट यािचका में नगर िनगम की ओर से प्रितवाद कराया जत्ला सुिनिश्चत करें। सम्पित्त अिधकारी झाँसी नगर िनगम झाँसी" 5. In view of the aforesaid instruction, if the petitioner desires to take alternative land, it may approach the respondent Nagar Nigam with a request, and the respondent Nagar Nigam shall acknowledge the request of WRIC No. 14776 of 2025 2 the petitioner and hand over the alternative plot to the petitioner expeditiously preferably within a period of one month from the date the petitioner approaches the respondent Nagar Nigam. 6.
