Neutral Citation No. - 2025:AHC:89180 Court No. - 4 Case :- WRIT - A No. - 6253 of 2025 Petitioner :- Aakash Rana And Another Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Hira Lal Yadav,Sunil Kumar Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J.
1. Learned Standing Counsel has obtained instructions in compliance of the order of this Court dated 20.05.2025 regarding cut off marks in the category of Dependents of Freedom Fighters in horizontal category in various categories other than the UR category. The sealed cover has been opened in the Court and according to which in the category of Dependents of Freedom Fighters (horizontal reservation), the last cut off normalized marks in open category is 93.44588, in the EWS category is 54.37646, in OBC category -7.19724, in SC category is -1.27947 marks, in ST category 90.59211. 2. A note is there that the EWS, OBC and SC/ST category as far as horizontal reservation is concerned, these marked with '*' showing it means many eligible candidates in these horizontal categories have been selected and no eligible candidate is left out. 3. Further note is appended that these are normalized marks of the last selected candidate available in the respective categories. It is further provided in the instructions that provision of negative marks was applied in the result of written examination as per the advertisement dated 23.12.2023 and -0.5 (negative) marks were given for every wrong answer. The examination was of 150 questions with 02 marks each. 4. It is further noted in the instructions that no minimum qualifying marks were provided in the advertisement under the relevant service rules. 5. Sealed cover contained letter written above with details that were given to be placed by the outsourced service provider to the controller of examination. The instructions show that Akash Rana and Ankit Pathak both belong to Dependents of Freedom Fighters general category could score 82.95823 and 90.84514 respectively
and hence they have not found place in the select list. The letter written to the controller of examination by the service provider Eduquity Career Technologies Pvt. Ltd. is placed back in the sealed cover and returned to the learned Standing Counsel. 6. In view of the above, no relief can be granted to those who have obtained less than last cut off in their respective categories. 7.
Insofar as the argument advanced that 2% reservation enblock has not been applied to the entire posts which were 60,000+ advertised, I do not see anywhere in any of the paragraphs that any statistics to be given which may place cogent grounds before the Court to question the selection qua reservation policy. The instructions are very clear to the effect that all the posts in the respective categories of reservation be vertical and horizontal reservation have been duly applied and all eligible candidates have been placed in the select list. On a pointed query being made,
learned counsel for petitioner could not cite any instance before the Court that 'N' number of vacancies fall in a particular quota that left out.
8. In my considered view, vague allegations made in paragraph nos.8 and 9 would not count to a cogent reason to question the selection and hence, I decline to grant indulgence in the matter.
9. Accordingly, this petition is dismissed.
