-2- Hon'ble Shri Justice Rakesh Mohan Pandey Order on Board 21.08.2025 1) The petitioner has filed this petition seeking the following relief(s):-
“10.i) That, this Hon'ble Court may kindly be pleased to issue a writ in the nature of mandamus in which may direct the respondents to produce entire concern records before this Hon'ble court for it's kind consideration. (ii) Further may kindly be pleased to issue a writ in the nature of certiorari by which may quash the impugned order dated 06.04.2022 of Collector- Annexure P-1. (iii) Further may kindly be pleased to issue a writ in the nature of certiorari by which direct the respondents no. 2 and 3 to consider first Mulyankan-Patrak Annexure P-2 as base of selection for the post of Aanganbadi Sahayika and do not consider second Mulyankan- Patrak- Annexure P-3 as it is bogus. (iv) Further may kindly be pleased to issue a writ in the nature of certiorari by which direct the respondents to issue appointment -letter /order in the favour of the petitioner on the basis of first Mulyankan-Patrak- Annexure P- 2.
(v) Further may kindly be pleased to issue any writ /order/ direction which Hon'ble Court deem fit in favour of the petitioner.” 2) Learned counsel appearing for the respondents would vehemently argue that the order passed by the District Magistrate/Collector, in the matter of Anganbadi Worker, is revisable before the learned Divisional Commissioner under the provisions of the Chhattisgarh Panchayati Raj Adhiniyam. 3) Learned counsel for the petitioner does not dispute the above fact. -3- 4) Considering the fact that an efficacious alternative remedy is available to the petitioner, I am not inclined to keep this petition pending. Accordingly, the present writ petition stands disposed of. The petitioner shall be at liberty to prefer a revision before the learned Divisional Commissioner. 5) If petitioner prefers a revision before the learned Divisional Commissioner, it is expected that the said authority shall consider the issue of limitation by taking a lenient view, as the matter has remained pending before this Court for a considerable period. It is further expected that the authorities concerned shall decide the revision expeditiously preferably within a period of 120 days from the date of its filing. 6) Certified copy, if any, be returned after retaining its xerox copy.
