3/23.04.2025 Heard Mr. Pran Pranay, learned counsel appearing for the appellant and Mr. S. K. Srivastava, learned A.P.P. appearing for the State.
This appeal is directed against the order dated 10.01.2025 passed in B. P. No. 1 of 2025 arising out of Madhupur P. S. Case No. 265 of 2024 by the Additional Sessions Judge I, Madhupur whereby and whereunder the prayer for bail of the appellant has been rejected.
It has been alleged that three unknown miscreants had come on a motor-cycle and exploded bombs on the wall of Dr. Samim, iron gate of Md. Nousad and courtyard of Nilu Devi.
Submission has been advanced by the learned counsel for the appellant that so far as the appellant is concerned, he has been implicated only on account of the fact that he had conversed with co-accused Chhotu Malik over mobile and self-confession of the appellant. He further submits that the appellant is in custody since 16.12.2024. Learned A.P.P. for the State has opposed the prayer for bail of the appellant.
Regard being had to the manner of implication of the appellant, we while setting aside the order dated 10.01.2025 passed in B. P. No. 1 of 2025, direct that the appellant above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of
-2- the like amount each, to the satisfaction of the learned ACJM, Madhupur in connection with Madhupur P. S. Case No. 265 of 2024.
This appeal is allowed.
