1. Heard Mr. N. Sarma, learned counsel for the petitioner. Also heard Mr. D.K. Roy, learned counsel for the respondent no.2. Mr. U. Sarma, learned counsel appears for the respondent nos.1. 2. Mr. Sarma, learned counsel for the petitioner submits that the petitioner submitted an application being no. CRC 96313 on 26.05.2022 with requisite fee, vide Challan No.56309 dated 06.06.2022, before the Board of Secondary Education, Assam (SEBA) which is now renamed as Assam State School Education Board (ASSEB). The application made by the petitioner was for correction of his father’s name from “Riwajal Islam” to “Riazul Hoque” in his Class IX Registration Card No.06/PR/0042/084052/16 dated 16.06.2017, as a student of Kukurmara Higher Secondary School, South Salmara Mankachar District. 2. The petitioner’s counsel submits that as no decision has been taken by the respondent no.2 on the petitioner’s representation till date, a direction may be issued to the respondent no.2 to take a decision on the petitioner’s application. 3. Mr. D.K. Roy, learned counsel appearing for the respondent no.2 submits that the documents that have been annexed by the writ petitioner in this writ petition, shows that all the documents have been obtained by the petitioner after appearing in his HSLC examination which was held in 2018. Page No.# 3/3 submits that as there are disputed questions of fact, the respondent no.2 would have to carefully look into the issue. He however submits that a decision can be taken by the respondent no.2 with regard to the application made by the petitioner. 4.
In view of the submissions made by the counsels for the parties, the respondent no.2 is directed to take a decision on the petitioner’s application dated 26.05.2022 as per it’s own discretion, within a period of 4 (four) weeks from the date of receipt of a certified copy of this order. 5.
